Generally

A broad range of commercial and civil cases, disciplinary and regulatory proceedings, applications for judicial review but also substantial experience in criminal matters, particularly involving fraud and dishonesty. Regular involvement in claims in both civil and criminal cases relating to the Basic Law and the Hong Kong Bill of Rights.

Employment and trade union disputes, including regular appearances for Cathay Pacific Airways and for the Hospital Authority.

Disciplinary Proceedings involving bodies such as the Medical Council, the Dental Council, the HK Society of Accountants, the Law Society and the HK Bar Association.

Contractual disputes: including defending Wembley PLC in proceedings by the HK Government to terminate Wembley’s management contract in relation to the Government Stadium, and appearing for Goldlion Properties in an action for specific performance against Regal National in relation to the sale of the Kimberley Hotel.

Corporate, banking and securities mattersincluding the dispute arising out of the removal of Walter Kwok as the CEO and executive director of Sun Hung Kai Properties; appearing in insider dealing inquiries for Robert Miller of the Search Group in relation to shares in Siu Fung Ceramic Holdings, for Shek Mei-Ling in relation to the shares in Hong Kong Worsted Mills, for Chia Siong Lim in relation to the shares in Lippo China Resources Ltd and for George Stairs of Fidelity in relation to Chaoda Modern Agricultural (Holdings) Ltd. Various shareholder disputes including those in the Playmates Group. Disputes in relation to “grey market trading” (for CEF Brokerage Ltd, and for Tullett & Tokyo FE Ltd). Trials in relation to letters of credit.

Judicial Review proceedings involving, amongst others, The Securities and Futures Commission, The Expatriate Civil Service Association, the HK Aircrew Officers Association, the Director of Civil Aviation, the Commissioner of Police, the Hospital Authority, the Telecommunications Authority, the Royal HK Jockey Club, The Medical Council of Hong Kong. The Dental Council of Hong Kong.

Public Inquiries: The Inquiry into the Opening of the Airport at Chek Lap Kok. The Inquiry into a killing in the Vietnamese Detention Camps. Advising the Hospital Authority in relation to the LegCo Select Committee into SARS and in relation to the Authority’s own Internal Inquiries into SARS.

Criminal matters, principally involving commercial fraud. Appeared for the auditors, Price Waterhouse, in the Carrian Trial; for the ICAC in the prosecution of a former acting Director of Public Prosecutions, Warwick Reid, and two solicitors and a barrister in private practice for corruption offences; and, more recently, for an officer in the Inland Revenue Department and her husband (a senior officer in the SFC) for alleged dishonest applications for Private Tenancy Allowance.

Defamation actions and Contempt proceedings.
Most recently for Cathay Pacific Airways Ltd in libel proceedings brought by “the 49ers”.

Real property disputes, usually involving disputes over conveyancing and mortgage matters.

Tax: Inland Revenue Board of Review appearances for Magna Industrial Ltd, Hewlett-Packard Asia Pacific Ltd, and Nishimatsu Construction Company Ltd.
