The Temple Chambers Moot 2025 was held on Saturday, 9 August 2025. This year’s moot problem centred on the “legitimate interest” test set out in 

White & Carter (Councils) Ltd v McGregor 

[1962] AC 413. Set in the context of a fictional dispute concerning a commercial rental agreement, teams addressed the question of whether liability in misrepresentation can arise if a statement of present intention as to future action is made negligently.

Teams from Hong Kong and UK universities presented arguments across three rounds. Judges praised the high standard of competition shown by all teams. We extend our heartfelt congratulations to all participants for their contributions to this memorable event.

The winning team – Ryan Li Hok Yu (who was also awarded Best Speaker) and Alric Wong Tung Fai – edged out Maurice Yim Man Leung and Timothy Chow Hoi Yan in the Grand Final, appearing before a panel comprising the Hon Mr Justice Thomas Au, Justice of Appeal (a former member of Chambers),

The Court of Final Appeal’s much anticipated judgment in 

Tenwow v PricewaterhouseCoopers Zhong Tian LLP

 [2025] HKCFA 17 addresses the Hong Kong Courts' jurisdiction to issue letters of request (“LOR”) for cross-border evidence gathering. This is the first contested case where a LOR was sought by a party to facilitate transfer of audit working papers in its – rather than in a non-party’s – possession. The judgment is important to stakeholders including Mainland audit firms and their former clients embroiled in Hong Kong litigation.

The appellants’ liquidators claim for over RMB 4.4 billion against the respondents for audit negligence. Some of the audit working papers were held by the respondent in Shanghai and potentially subject to PRC regulatory restrictions on transfer to Hong Kong. The respondent applied to the Hong Kong Court to issue a LOR to the Shanghai Court. The request was initially denied by Anthony Chan J (as he then was), but allowed by the Court of Appeal.

Upholding the Court of Appeal’s decision, the CFA held that:
