The Temple Chambers Moot 2024 was held on Saturday, 3 August 2024. This year’s moot problem centred on the topical issue of whether airline no-show policies may be unenforceable as a result of the penalties doctrine. The Court of Final Appeal in Hong Kong has yet to reconsider the proper approach to the penalties doctrine in light of the decision of the UK Supreme Court in Cavendish Square Holding BV v Talal El Makdessi and ParkingEye Ltd v Beavis [2016] AC 1172.
Teams from Hong Kong and UK universities presented very high calibre arguments across three rounds as to what the law on penalty clauses should be in Hong Kong. We extend our warmest congratulations to all participants for their stellar contributions to a most memorable event.
